The Federal High Court, Abuja, has allowed a request by the former Minister of Petroleum, Diezani Alison-Madueke, to provide proof of her acquittal by the Southwark Crown Court in London, UK. Local Guides of City
The motion on notice was moved by Diezani’s lawyer, Godwin Iyinbor, and was not opposed by the Economic and Financial Crimes Commission’s attorney, Mofesomo Oyetibo, Channels TV reports.
The UK court on 17 June released and cleared the troubled former minister of criminal allegations of bribery made against her.
Diezani has filed a suit before Justice Ekwo to recover her confiscated assets.
The day’s proceedings had Iyinbor and Oyetibo regularise their processes filed.
Iyinbor, therefore, sought leave from the court to submit a motion on notice, filed on June 25.
The application, he said, was seeking permission to file a further/supplementary affidavit to bring a fresh and material development regarding the acquittal of Diezani by the UK court.
The application also requested an order that the affidavit be deemed properly filed, he added.
Oyetibo said he had been served with the application.
The EFCC’s lawyer further stated the request was meant to waste the judicial time of the court.
But Justice Ekwo questioned whether he was going to oppose it or not and the lawyer answered they are not opposing to the application.
The judge accordingly approved the prayer of the motion and adjourned the subject until October 6 for hearing.
The court ruled that the preliminary objection and the main litigation shall be taken simultaneously on the next adjourned date.
