A witness for the People’s Democratic Party (PDP) and its presidential candidate in the February 25 general election, Abubakar Atiku, named Mr. Hitler Nwala, testified before the Presidential Election Petition Court (PEPC) in Abuja that INEC deleted election results in all 110 BVAS machines he inspected.

According Atiku and PDP had Digital Forensic Analyst Nwala subpoenaed to testify in their petition challenging the All Progressives Congress’s declaration of President Bola Tinubu as winner of the presidential election.

Nwala testified under cross-examination by petitioner’s lead counsel Chris Uche SAN that only BVAS machines in the Federal Capital Territory were inspected, and that he did not know when the results were deleted from the machines.

When questioned by INEC attorney Abubakar Mahmoud SAN, the witness testified that he used a standard device for such an exercise to determine the result.

The commission authorized the witness to attach an external device to the BVAS machine, the witness said.

When asked if he realized that the 3.4% of BVAS in the FCT and the 0.6% of BVAS nationwide that were inspected came to only 110 machines, Nwala said he only compiled the report and didn’t calculate the percentage.

The INEC attorney tried to have Nwala collect a BVAS machine in open court to verify whether or not data had been deleted as claimed, but Nwala refused, citing professional ethics.

Accessing a device that will be used as evidence in a court of competent jurisdiction is unethical from a professional standpoint because doing so could taint the results of the case.

We are unable to enter the device itself, so we must instead remove evidence from it.

The witness testified that he couldn’t tell which device it was just by looking at it because they were all the same model and design.

Lateef Fagbemi, SAN, counsel for the All Progressives Congress, told the witness that neither he nor any member of his team had signed the six-volume forensic report.

However, the witness insisted on putting his name on both the report and the certificate of compliance.

Counsel for President Bola Tinubu, Chief Wole Olanipekin, SAN, showed the witness a section of his report in which he stated that “nothing was intrinsically wrong with them” after inspecting the machines.

When the presidential election took place, did you happen to be in Abuja?

If you weren’t present in Abuja on election day, how could you possibly have known that the voting machines were functioning properly?

Nwala claimed ignorance of any voting machine problems on election day because he was not present in Abuja.

Meanwhile, the petitioners submitted Forms EC8A series from 20 LG areas in Ogun, 17 LG areas in Ondo, 27 LG areas in Jigawa, and 20 LG areas in Rivers.

Justice Haruna Tsammani, the PEPC’s chairman, has postponed today’s hearing until tomorrow.
