The World Court of Human Rights has unanimously and verbatim determined that there is no right to same-sex marriage since 2016. The 47 judges from the 47 countries of the Council of Europe, who are members of the Plenary Court of Strasbourg (the most important human rights court in the world), issued a statement that has been surprisingly muted by the advancement of information and its sphere of influence.
In fact, all 47 justices agreed unanimously that “there is no right to same-sex marriage.” Numerous philosophical and anthropological considerations based on the natural order, common sense, scientific reports, and, of course, positive law informed the sentence. In the latter instance, in particular, the ruling relied on Article 12 of the European Convention on Human Rights.
This also applies to human rights-related treaty resolutions, including Article 17 of the P San José Act and Article 23 of the International Covenant on Civil and Political Rights. In these landmark decisions, the Court determined that the concept of family encompasses not only “the traditional concept of marriage, that is, the union of a man and a woman,” but also that governments should not be required to “open marriage to persons of the same sex.” Regarding the non-discrimination principle, the Court added that there is no discrimination because “states are free to restrict marriage to heterosexual couples.”
