Justice A.L Adegoke of the Osun State High Court sitting in Ikirun has given an order of perpetual Injunction restraining the Oluwo of Iwo, Oba Abdulrasheed Adewale Akanbi and any other member of the Registered Trustee of Iwo Central Mosque, Osun State from preventing and restricting an Islamic cleric, Shayk Khalifa Adio Imran, from performing his Islamic religious duties in Iwo Central Mosque and Eid Praying Ground.
The court also restrained them and their privies from arresting or restraining Shayk Imran’s fundamental rights in Iwo Central Mosque, Osun State, or anywhere in Nigeria as contained in Sections 34, 35, 36 and 38 of the 1999 Constitution of the Federal Republic of Nigeria (as amended).
Further, the court held that Oba Akanbi and any other member of the Registered Trustee of Iwo Central Mosque, have no power under the Nigerian Constitution or any other laws to deny, prevent or refuse Shayk Imran’s fundamental right to practice his Islamic religion anywhere in Nigeria as entrenched in Section 34, 35, 36 ad 38 of the 18999 constitution (as amended).
It also held that the Oluwo of Iwo’s oral decree at the Eid Praying Ground of Iwo Central Mosque, Osun State on June 4, 2019, removing and preventing Shayk Imran from performing his religious duties in both Iwo Central Mosque and Eid Praying Ground is wrongful, unlawful and unconstitutional as it violates Imran’s fundamental rights to religion.
Justice Adegoke gave the orders while ruling on a suit delineated HIK/25/2019 filed by Shayk Imran against the Oluwo of Iwo and five others; Commissioner of Police, Osun State, Shayk Hasim Ejalonibu, Chhief Abiola Ogundokun, Alhaji Jimoh Alake and Barrister Tawfiq Ishola Tewogbade.
Shayk Imran was until the event in 2019, the Otun Ajanasi of Iwo land before he was removed during the Eid event by the Oluwo of Iwo on June 4, 2019.
