Court fixes July 21, for suit seeking Buhari’s removal

The Federal High Court Abuja has fixed July 21, for hearing of a suit instituted by a Presidential flagbearer of the Hope Democratic Party in the 2019 general election, Chief Ambrose Owuru against President Muhammadu Buhari.
By the suit, the plaintiff is asking the court to declare the Presidential seat vacant.
The date for suit was communicated to parties in the suit through hearing notices served on them by the court bailiff.
The Chief Judge of the Federal high Court, Justice John Tsoho assigned the case to Justice Inyang Ekwo for adjudication.
Specifically, the HDP presidential candidate wants the court to declare Buhari as an unlawful President, who is illegally occupying the Presidential seat.
Owuru, a British trained constitutional lawyer is praying the court to declare him the authentic winner of the 2029 presidential poll.
More so, he is seeking an order of court directing his immediate inauguration to take over from Buhari.
Owuru filed the suit on June 16, 2021 against President Buhari, the Attorney General of the Federation, and the Independent National Electoral Commission.
In addition, the HDP presidential candidate is boastfully claiming that he won the February 16, 2019 Presidential debate and that his suit against Buhari at the Supreme Court was inconclusive due to some errors on the adjourned date.
By the suit, the plaintiff wants a declaration that he is entitled to serve out a tenure of 4 years after his formal inauguration.
Owuru also wants Buhari removed from office with immediate effect and be compelled through order of court to refund all salaries, allowances and emoluments he collected while being unlawfully in office as President.
The plaintiff further seeks an order of perpetual injunction restraining Buhari, Attorney General of the Federation and the INEC from any further organizing, and conduct of any Presidential election in 2023, to enable him complete his 4 year term when inaugurated. (Daily Independent)
